General Terms and Conditions (GTC)

of Třinecká realizační s.r.o., registered office Žihla 978, 739 91 Jablunkov, Czech Republic, identification number (IČO): 29441269, registered with the Krajský soud v Ostravě, sp. zn. C 53375 (hereinafter "Seller"), for the online sale of goods via the online shop operated at www.rubber-paint.co.uk.

§ 1 Scope

These General Terms and Conditions (GTC) apply to all orders placed through our website in the online shop. Our online shop is aimed at both consumers and businesses.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside his or her trade, business or profession.

An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her independent professional or commercial activity.

§ 2 Contracting party, conclusion of contract

The purchase contract is concluded with Třinecká realizační s.r.o.

The presentation of products in this online shop does not in principle constitute a legally binding offer, but is merely an invitation to submit a binding, chargeable order by the customer. After placing the desired goods in the shopping cart and going through the ordering process, you finally place a binding order for the goods contained in the shopping cart by clicking the "Buy now" button. Immediately after sending the order, you will receive an e-mail confirming receipt.

The purchase contract with us is concluded upon sending the order confirmation or delivery of the goods.

§ 3 Contract language and storage of contract data

The language available for concluding the contract is English. The contractual terms with details of the ordered goods and prices will be sent to you by e-mail.

§ 4 Prices and payment terms

All prices in the shop are stated in euros (€) and include value-added tax. In addition to the indicated product prices, shipping costs may apply, which are transparently shown in the shopping cart and at checkout.

Depending on availability, the following payment methods are available:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Klarna (invoice, installment payment, SOFORT transfer)
  • Apple Pay / Google Pay
  • Advance payment by bank transfer

For advance payment, the goods are shipped only after the full payment has been received.

§ 5 Delivery and shipping conditions

We generally deliver to all EU countries and the United Kingdom. Exact shipping costs per country can be found in our shipping information.

The delivery time is generally:

  • Germany, Austria, Czechia, Slovakia, Poland, Hungary: 2–4 working days
  • Other EU countries: 3–7 working days
  • United Kingdom: 5–10 working days (customs clearance)

Delivery to parcel stations is unfortunately not possible. Partial deliveries are permitted if reasonable for you; no additional shipping costs arise.

§ 6 Free shipping

From an order value of €199 we deliver free of charge within the EU and to the United Kingdom. This offer applies only to orders placed through our online shop and may be changed at any time without notice.

§ 7 Retention of title

The goods remain our property until full payment has been received.

§ 8 Behaviour in case of transport damage

In the case of externally visible damage to the shipment, we recommend noting this on the carrier's freight documents and obtaining written confirmation of the damage from the carrier. In particular, check whether the contents are damaged or missing and contact us immediately by e-mail at info@rubber-paint.eu or by phone at +420 605 333 955.

Your statutory rights and our liability for the goods remain unaffected.

§ 9 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. Details are set out in our withdrawal information.

§ 10 Statutory warranty and guarantee

The statutory liability rights for defects apply. For consumers, the limitation period is 2 years from receipt of the goods. For businesses, the limitation period is 12 months.

In the case of obvious defects, businesses must report them within 7 days of receipt of the goods. In the case of hidden defects, the report must be made within 7 days of discovery.

Our customer service is available to answer questions about complaints, returns or incorrect deliveries Monday to Friday (9:00 a.m. to 5:00 p.m.) by e-mail at info@rubber-paint.eu.

§ 11 Liability

The Seller is liable without limitation for damages caused by intent and gross negligence and for damages from injury to life, body or health.

In the case of slight negligence, the Seller is liable only in the event of a breach of material contractual obligations (cardinal obligations); liability is limited to the foreseeable damage typical of the contract.

Liability under the Product Liability Act remains unaffected.

§ 12 Data protection

We process your personal data for the performance of the contract and within the framework of statutory provisions (GDPR). Without your express consent, we do not pass on any personal data to third parties unless this is necessary for the execution of the contract (e.g. to shipping service providers or payment service providers). § 13 Code of conduct

We have not submitted to any specific code of conduct.

§ 14 Online dispute resolution

We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

§ 14a Pre-contractual sustainability information (from 27 September 2026)

In accordance with the EU requirements applicable from 27 September 2026, we inform you before conclusion of the contract about the following characteristics of our products:

  • Shelf life / storage: Universal liquid rubber has a shelf life of at least 36 months from the date of manufacture when stored unopened at 5–25 °C in the original container. Protect from frost.
  • VOC content: Our water-based coating is low in VOC in accordance with Directive 2004/42/EC, category A/c (interior and exterior matt coating), limit value < 40 g/l.
  • Packaging: Bucket made of recyclable polypropylene (PP, recycling code 5). Please dispose of via municipal recycling collection.
  • Tool cleaning: With water. No solvent required.
  • Statutory warranty: 24 months in accordance with EU consumer law.

§ 14b Withdrawal button and online withdrawal (from 19 June 2026)

From 19 June 2026, we will provide a withdrawal button on our website through which you, as a consumer, can exercise your right of withdrawal online. The associated form will only collect the data necessary (name, order number, e-mail). A confirmation will be sent to you by e-mail. Details in our withdrawal information.

§ 14c Information for buyers in France — Médiateur de la consommation

For orders from France, in the event of a dispute, you may use the free mediation service of the national Médiateur de la consommation. Please first contact our customer service in writing (info@rubber-paint.eu) for out-of-court dispute resolution. Further information is available at www.economie.gouv.fr/mediation-conso.

§ 14d B2C / B2B distinction

These GTC apply in full to consumers (B2C). For entrepreneurs and legal entities under public law (B2B), the following deviating rules apply: The statutory right of withdrawal for consumers does not apply. The statutory warranty period is 12 months from delivery. For B2B orders, the exclusive place of jurisdiction is the registered office of the Seller. If you wish to expressly order as a B2B customer, please contact our B2B service.

§ 15 Final provisions

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For orders from entrepreneurs or legal entities under public law, the exclusive place of jurisdiction is the registered office of the Seller. For consumers, the statutory places of jurisdiction apply.

If individual provisions of these GTC are or become invalid, the validity of the remaining provisions remains unaffected.
